1. Acceptance of Terms
By accessing or using GoodWatch, you agree to be bound by these Terms of Service and our Privacy Policy, which is incorporated into these terms by reference. If you do not agree, please do not use our service. You must be at least 18 years old or the age of majority in your jurisdiction to create an account.
2. Description of Service
GoodWatch is a kids streaming service that provides curated, age-appropriate video content for children. Our service includes a personalized onboarding experience to match your child with content suited to their age and interests, and a streaming library accessible through web browsers and our mobile applications.
3. Content and Age Appropriateness
All content on GoodWatch is curated for children. While we make every effort to ensure content is appropriate for the age ranges indicated, parents and guardians are responsible for supervising their children's viewing and determining what is suitable for their family.
We do not guarantee that all content will be suitable for every child. Content preferences selected during onboarding help us personalize recommendations, but parents should review content selections.
4. Parental Responsibility
GoodWatch accounts are created and managed by parents or legal guardians. By creating an account, you confirm that you are a parent or legal guardian and accept responsibility for your child's use of the service.
You are responsible for supervising your child's access to the service and ensuring their use is consistent with your family's values and guidelines.
5. Children's Privacy
GoodWatch is intended to be set up and managed by adults. Any information provided during onboarding about a child's age or content interests is provided by the parent or legal guardian, who consents to our handling of that information on the child's behalf. Our collection and use of information relating to children and families is described in our Privacy Policy. If you believe we have collected information from a child in a manner inconsistent with our Privacy Policy, please contact us at help@goodwatch.com.
6. Payment and Access
GoodWatch offers access through a one-time payment. Purchases made directly through us on the web are processed via Stripe, our payment processor. Upon successful payment, you receive access to the GoodWatch streaming library for the operational lifetime of the service (see Section 14 regarding service changes and discontinuation).
If you purchase or access GoodWatch through a third-party app store (such as the Apple App Store), that transaction, including billing, is governed by the terms and policies of that app store rather than by this section. See Section 8.
Price changes:We may change pricing for new purchases with at least 30 days' notice. Members who have already purchased access are not affected by price changes.
7. Refunds
For purchases made directly through us on the web, we offer a 7-day money-back guarantee from the date of purchase. If you are not satisfied with GoodWatch, contact us at help@goodwatch.com within 7 days of your purchase for a full refund.
Purchases made through a third-party app store are subject to that store's refund policies and processes, which we do not control. For Apple App Store purchases, refund requests are handled by Apple.
8. App Stores and the Application
Our mobile applications are made available through third-party app stores. Your license to install and use the application itself is governed by the applicable app store's standard end user license agreement, and any purchases you make through an app store are governed by that store's terms. These Terms of Service govern your use of the GoodWatch service and are separate from those app store agreements; where they conflict with respect to the application or an app store purchase, the app store's terms control for that subject matter.
9. Video Streaming Terms
Content on GoodWatch is licensed for personal, non-commercial, household use only. You may not download, copy, reproduce, distribute, or publicly display any content from the service without our written permission.
Streaming quality may vary based on your internet connection and device. We do not guarantee uninterrupted or error-free streaming.
10. Account Security
You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. Notify us immediately at help@goodwatch.com if you suspect unauthorized access.
11. Acceptable Use
You agree not to misuse the service, including but not limited to: attempting to circumvent access controls, using automated tools to access content, sharing account credentials outside your household, or using the service for any unlawful purpose.
12. Suspension and Termination
We may suspend or terminate your access to the service if you violate these terms, misuse the service, or engage in conduct that we reasonably believe is harmful to GoodWatch, other users, or third parties. Where practical and lawful, we will provide notice. If we terminate your access for a reason other than your breach of these terms, and you purchased access directly through us, we may provide a prorated or full refund at our discretion. You may stop using the service at any time.
13. Intellectual Property
All content, trademarks, and materials on GoodWatch are owned by or licensed to us. Your purchase grants you a limited, non-exclusive, non-transferable license to access and stream content for personal use.
14. Service Changes and Availability
We may modify, add, or remove features and content over time. We aim to keep GoodWatch available continuously, but we do not guarantee that the service, or any particular content, will be available indefinitely. If we discontinue the service entirely, we will make reasonable efforts to provide advance notice to members.
15. Limitation of Liability
GoodWatch is provided "as is" without warranties of any kind. To the maximum extent permitted by law, we are not liable for any indirect, incidental, or consequential damages arising from your use of the service.
Our total liability for any claim related to the service is limited to the amount you paid for the service in the 12 months preceding the claim.
16. Dispute Resolution and Arbitration
Please read this section carefully, as it affects your legal rights. Except for disputes that qualify for small claims court, you and GoodWatch agree to resolve any dispute arising out of or relating to these terms or the service through binding individual arbitration, rather than in court. Arbitration will be conducted by a recognized arbitration provider under its applicable consumer rules.
Class action waiver: You and GoodWatch agree that each may bring claims against the other only in an individual capacity, and not as a plaintiff or class member in any purported class or representative proceeding.
Opt-out: You may opt out of this arbitration agreement by emailing help@goodwatch.com within 30 days of first accepting these terms, stating your name and that you wish to opt out. Opting out will not affect any other part of these terms.
17. Changes to Terms
We may update these terms from time to time. Material changes will be communicated via email or a notice within the service. Continued use after changes take effect constitutes acceptance.
18. Governing Law
These terms are governed by the laws of the State of Delaware, without regard to conflict of law principles. Any dispute not subject to arbitration under Section 16 will be resolved in the state or federal courts located in Delaware.
